The Beijing No 1 Intermediate Court rejected a suit from P&G against the State Administration of Industry and Commerce (SAIC) after its application for a trade mark for a toothpaste product was rejected.
P&G applied to register the trademark of Clarity on April 8, 2003, but SAIC ruled the trademark was very similar to an existing tooth product of Clarify.
The court ruled the two trademarks might be confused by consumers.
