Olympic ads

Beijing will overhaul advertisements in the city to ban any unauthorized use of Olympics logos in ads. Chen Feng, a marketing official with the Beijing Organizing Committee for the Games of the XXIX Olympiad (BOCOG), was quoted by the People's Daily recently as saying that inspection teams will be sent to airports, railway stations, places near Olympic venues and other public areas as from July 11 to check whether ads contain unauthorized Olympic logos and the Beijing Olympic signs.

The overhaul will last till Sept 17 when the Paralympics ends in Beijing, the newspaper said.

The BOCOG will also monitor electronic media as well as on-line ads.

Any violation would lead to fines or punishment according to the Olympic intellectual property protection regulations, Chen said.

Meanwhile, BOCOG widely publicized that no drinks other than those from the official Olympic soft drink sponsor, Coca-Cola, would be allowed at Olympic venues during the Beijing Olympics, scheduled to open on Aug 8.

Trademark regulation

Guangdong provincial government recently approved the "Guangdong Famous Trademark Identification and Management Regulations".

Officials say the document will play a significant role in regulating famous trademark recognition, protecting legitimate rights and interests of famous trademarks owners and enhancing market competitiveness of the enterprises.

The regulations clarify the conditions for famous trademarks and simplify the assessment procedures. According to the regulations, a famous trademark review committee will be established. Regulatory measures will be taken to supervise the transfer, licensing and alteration of famous trademarks, so as to prevent the abuse of well-known trademarks and protect the legitimate rights and interests of trademark owners.

As of the end of 2007, the total number of registered trademarks in Guangdong province has exceeded 380,000, ranking the first in China for 13 years. The amount of famous trademarks reached 108, also taking the first place in the country.

Key IPR enterprises

To promote the IPR work in enterprises and enhance their ability of IPR creation, use, management and protection, the Intellectual Property Office, the Economic and Trade Commission and the Finance Bureau of Shanxi province recently formulated the "Implementation Plan on Cultivating 100 Key IPR Enterprises".

The plan is divided into seven parts, including development targets and methods, conditions for enterprises, contents and objectives, promoting measures, organizational management as well as examination acceptance.

The plan aims to cultivate 100 large-scale IPR enterprises in pillar industries and hi-tech industry. The enterprises will be divided into three batches and cultivated in three years.

Shanxi intellectual property office and other relevant departments will take measures to make full use of existing policies, study and formulate relevant policies, and vigorously promote the development of 100 key IPR enterprises, according to the plan.

The Intellectual Property Office would also organize examination and assessment, and award the qualified enterprises with the title of "Top 100 IPR Enterprises in Shanxi Province".

IP management in foreign trade

Jiangsu provincial foreign trade and economic cooperation bureau and Jiangsu intellectual property office recently formulated the "Opinions on Strengthening Intellectual Property Management of Enterprises in International Trade".

The document aims to strengthen IPR management in international trade enterprises, enhance their capabilities in IPR creation, utilization, protection and management and raise the international market competitiveness.

The opinions give specific suggestions from aspects of IPR management and use; IPR protection in import and export, joint venture and cooperation, overseas investment, exhibition and trade promotion; countermeasures for IPR disputes; government support and assistances for international trade enterprises.

The document offers guidance on patent licensing and transfer contracts, as well as IPR related issues in Sino-foreign joint ventures, cooperative enterprises, exhibition and disputes, which will help enterprises enhance IPR protection and management.

Counterfeiting case

Shanghai Customs has seized 4,800 pairs of sneakers with Beijing Games logos, the biggest case of Olympic counterfeiting this year in the city.

The sneakers were to be exported to Ecuador by a Shandong-based company on June 17. Customs officials found during a routine check that every pair of shoes were marked "Beijing 2008".

Officials alerted BOCOG who said the sneakers were fakes and customs officials seized the goods.

Shanghai Customs has discovered 14 cases involving 33,000 items that were marked with Olympic symbols and logos, which has been illegal since the regulations on the protection of Olympic symbols were issued in 2002.

The most commonly seized illegal products have been shoes, bicycles and suits.

Just 10 days earlier, Shanghai Customs seized 1,440 gate locks that were to be exported to Chile. All the locks were illegally displaying the five-ring symbol of the Olympics, Customs officials say.
