IPR aid fund to be established after copyright lawsuit against Japanese TV station station

Recently, commissioned by 10 copyright holders of the TV series which were illegally broadcasted by the unauthorized Japanese SKY PerfecTV station, three Beijing law firms officially sent the lawyer's letter to the Japanese TV station, which marks the formal start of the collective action.

In contacts with the copyright holders, the law firms found that many companies have various concerns on this litigation. "Some worry about the time and labor costs for litigation in Japan, some concern about the expensive retaining fees, and some are afraid of the risks in compensation" said one lawyer.

Therefore, the three law firms decided to switch operation mode of the litigation. At the initial stage, the law firms would waive the legal fees. Once the lawsuit is won and the infringement compensation is obtained, half of the compensation will be returned to the copyright holders, and the remaining half, after deducting the charges by Japanese courts, will be established as an assistance fund for international IPR litigation.

It is learnt that, so far, the Japanese satellite broadcasting company has not ceased infringing acts. The preparatory mission is now contacting with local attorneys and working on legal proceedings.
